COMMISSIONER’S PROCEEDINGS

December 31, 2018

The Rooks County Commissioners met in regular session.  Those present were the Commissioners:  John Ruder, Larry Poore, and Corky Hagan.  Ruthmary Muir, Rooks County Clerk, was present to write the minutes.  Virgi Laska, with the Stockton Sentinel, and Greg Balthazor, Commissioner Elect, were also present.  The agenda was approved as presented. 

The Commissioners reviewed the minutes from December 17th.  Ruder made a motion to approve the minutes with a minor correction.  Poore seconded the motion, and Hagan agreed.  After the minutes were printed, Hagan made a motion to sign the minutes.  Poore seconded the motion, and Ruder agreed.

In weekly reports, Hagan reported that the conditions of the roads seem to be getting worse.  With approximately two inches of rain in his area, the creeks are overflowing again, and the roads are bad.  Poore had passed some road concerns along to the Road Supervisor.  Interestingly, Poore’s neighbor had calculated the yearly rainfall at 45” for the year, and Rooks County’s normal rainfall is approximately only 24”.  Poore will join a conference call with Work Force One to approve their payroll program.  Ruder had received a phone call about the previously discussed road near Conyac’s. 

The Commissioner’s signed the transfer form to transfer left-over budget monies to their Equipment Fund. 

Rich Bouchey, Road & Bridge Supervisor, was present for his department’s report.  Bouchey had switched section-men around to compensate for Dale Gager’s upcoming retirement.  Bouchey and the Commissioners discussed road concerns and wash-outs, and Hagan let Bouchey know about the road conditions in the southern part of the County; especially 10 Road. 

Equipment repairs: the ‘head’ part of the Western Star semi needs to be re-built.  It is at Foley Equipment at this time for the repairs. 

Bouchey had received some applications for a position in the department.  Ruder made a motion to go into executive session for the purpose of non-elected personnel for ten minutes from 9:50 am until 10:00 am.  Hagan seconded the motion, and Poore agreed.  Those present for the executive session were: Commissioners John Ruder, Larry Poore, and Corky Hagan; Rich Bouchey, Road & Bridge Supervisor, and Greg Balthazor, Commissioner Elect.  Upon returning to regular session, there was no further discussion. 

Bouchey presented some reclassifications for his department.  The following reclassifications were approved effective December 25, 2018 for the 2019 payroll year.

                Chet Rudman to Class V

                Mark Brown to Class V

                Terry Pulec to Class IV

                Randy Odle to Class IV

                Rick Axelson to Class III

Ruder made a motion to sign Resolution 2018-R8 to create a county equipment reserve fund to finance the acquisition of equipment from the Rooks County Golf Course Equipment Reserve Fund.  Poore seconded the motion, and Hagan agreed.  Resolution as follows:

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS

FOR ROOKS COUNTY, KANSAS (Enabling Statue K.S.A. 19-119)

2018-R8

NOW, on this 31st day of December, 2018, the same being a regular meeting day of the Board of Rooks County Commissioners who are meeting with their Clerk and Attorney to conduct such business as may come before them:

WHEREAS, the Board of County Commissioners, by resolution is authorized and empowered to create a county equipment reserve fund to finance the acquisition of equipment.

WHEREAS, moneys may be budgeted and transferred to such fund from any source which may be lawfully utilized for the purposes set forth in K.S.A. 19-119(a).

NOW THEREFORE, be it resolved by the Board of Rooks County Commissioners that a Rooks County Golf Course Equipment Reserve Fund is hereby established to finance the acquisition of equipment.

BE IT FURTHER RESOLVED, that pursuant to K.S.A. 19-119, any unused year end budget authority may be transferred from the Rooks County Golf Course Fund into the Rooks County Golf Course Equipment Reserve Fund to be used in the manner prescribed in said K.S.A. 19-119, by the County.

Ruder made a motion to sign the approved 2019 Soil Conservation budget as requested.  Poore seconded this motion, and Hagan agreed. 

A thank you was received from Roger Hrabe, Economic Development Director, thanking the Commissioners for the gift certificate for Christmas.  A Christmas card was received from HMI Architects, and a letter was received concerning the County agreement to treat noxious weeds along state and federal highways during the 2019 season.  This letter will be forwarded to the Noxious Weed Director. 

The minutes from the High Plains Mental Health Center’s board meeting were received and reviewed. 

Ruder made a motion to sign hand check #69284 to Manatron in the amount of $225.00.  This check corrected an earlier check made out to the wrong vendor.  Hagan seconded the motion, and Poore agreed. 

Hagan made a motion to review, approve and sign the weekly vouchers, December’s payroll, and the Treasurer’s small fund vouchers.  Poore seconded the motion, and Ruder agreed.

Ruder made a motion to sign Resolution 2018-R9 to transfer monies from the Rooks County Sheriff’s Special Equipment Fund back into the Rooks County General Fund to be credited towards the Rooks County Sheriff’s budget.  Poore seconded the motion, and Hagan agreed.  Resolution as follows:

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS

FOR ROOKS COUNTY, KANSAS (Enabling Statue K.S.A. 19-119)

NOW on the 31st day of December, 2018, the same being a regular meeting day of the Board of Rooks County Commissioners who are meeting with their Clerk and Attorney to conduct such business as may come before them:

WHEREAS, if the County commissioners of any county determines that money credited to an equipment reserve fund is not needed for the purposes for which so transferred, by resolution, may transfer such amount not needed back to the fund from which it came; and

WHEREAS, the board has determined that moneys transferred to the Rooks County Sheriff Special Equipment Fund are not needed for the purposes as described in K.S.A. 19-119(a) and should be transferred back into the budget of the Rooks County Sheriff. 

NOW THEREFORE, be it resolved by the Board of Rooks County Commissioners that pursuant to K.S.A. 19-1199(c), $16,000.00 shall be transferred from the Rooks County Sheriff’s Special Equipment Fund back to the Rooks County general Fund to be credited towards the budget of the Rooks County Sheriff.
